What is an Enduring Power of Attorney?
An Enduring Power of Attorney (EPOA) is a legal document where you appoint someone to make health and personal decisions on your behalf if you become incapable of making your own decisions – for example, if you have diminishing cognitive health or lose capacity to make decisions. You can also use this document to decide who can make decisions about your finances, either starting immediately, from a particular date or upon an occasion or event.
How is it different from a General Power of Attorney?
An Enduring POA has effect even after you’ve lost capacity, while a General POA is used to appoint someone to undertake financial decisions on your behalf for a specific period only, such as while you are travelling. It’s used while you can still make your own decisions and ends once the specified time period lapses or you lose capacity to make decisions.
But I’m a healthy, young adult. Why do I need an EPOA?
EPOA’s are not only needed by the sick or the elderly, but by every adult who wants to be able to control who can make decisions on their behalf if they become unable to.
